Article 3: Agreement
3.1 The agreement is concluded as soon as a quotation or offer from Westerpark Computers & Telecom is accepted by the customer.
3.2 If, due to circumstances unknown at the time the agreement was concluded, additional work must be performed, Westerpark Computers & Telecom will inform the Customer in advance if the extra costs exceed €50 of the original quote. If the Customer objects to the extra costs, they may cancel the work that has not yet been performed. In that case, the Customer is obliged to reimburse Westerpark Computers & Telecom for the work performed up to that point and any costs already incurred (such as specially ordered parts).
3.3 If a Customer wishes to cancel the Assignment, this is only possible for the part of the work that has not yet been performed.
Article 4: Execution of Services
4.1 Customers with an appointment shall take precedence over customers without an appointment.
4.2 Upon delivery of the Device, Westerpark Computers & Telecom will request the access code in order to test certain functions. If a customer provides this access code, they thereby grant permission to Westerpark Computers & Telecom to use this code for testing functions.Â
4.3 Westerpark Computers & Telecom has the right to restore the Device to its original factory settings.
4.4 The Customer is personally responsible for providing the correct information to Westerpark Computers & Telecom.
4.5 Westerpark Computers & Telecom strives to use Original Parts for its repairs. If this is not possible, parts of the highest attainable quality will be used, unless agreed otherwise.

Starting from thirty (30) days after the initial notification, Westerpark Computers & Telecom is entitled to charge storage fees amounting to €5 per day. Westerpark Computers & Telecom retains the right of retention (lien) on the Device until all outstanding invoices, including any storage fees, have been paid in full. If the Device has still not been collected after ninety (90) days and following repeated written demands, Westerpark Computers & Telecom has the right to sell or dismantle the Device to cover the outstanding claims and costs incurred.
Article 5: Returns, Warranty, Costs, and Payment
5.1 For purchases made physically in the store, Westerpark Computers & Telecom grants Consumers a non-binding goodwill period of 7 days after purchase to return a product without giving reasons. This applies exclusively upon presentation of the original receipt and provided that the product is undamaged and in its original, unopened packaging. The basic principle is that the Customer may only handle and inspect the product as they would be allowed to do in a store. Any costs and risks for the return shipment shall be borne by the customer.
For online purchases (webshop), Consumers are entitled to the statutory cooling-off period of 14 days in accordance with the right of withdrawal.
5.2 The cooling-off period/goodwill period referred to in paragraph 5.1 does not apply to top-up cards, personalized products, Business Customers, and second-hand smartphones, tablets, and laptops purchased physically in the store. These cannot be returned.
5.3 After repair by Westerpark Computers & Telecom, it grants the Customer a three (3) month warranty on the parts installed during the repair. The warranty shall never apply to cracks in the glass or LCD, water damage, other drop or impact damage, or damage caused by the customer themselves (including incorrect or improper use).
5.4 Although Westerpark Computers & Telecom uses original parts, it cannot be guaranteed that the manufacturer's warranty on the Device will remain valid.Â
5.5 If it is not possible to repair the Device, the customer does not have to pay for this. Westerpark Computers & Telecom is entitled to charge the customer for any costs incurred, such as ordering specific parts or products. In the case of water damage, diagnostic fees will be charged.Â
Â
5.6 The costs for the repair are the costs as shown on the receipt of issue.
5.7 These costs must be paid immediately by the Customer in the store upon collecting the Device or product. If Westerpark Computers & Telecom orders products and/or parts at the request of the customer, the Customer must make a down payment of at least 50%.
5.8 Phones that are manufactured by the producer to be waterproof may lose this waterproofness after a repair. Following a repair, Westerpark Computers & Telecom is not liable for the waterproofness of a device.
Article 6: Liability
6.1 Westerpark Computers & Telecom only has an obligation of best efforts towards the Customer. Westerpark Computers & Telecom can therefore never be held liable for failure to achieve the desired result.
6.2 If Westerpark Computers & Telecom is nevertheless held liable, Westerpark Computers & Telecom shall only be liable for direct damage actually incurred, paid, or suffered by you due to a demonstrable failure to meet our obligations with respect to our Services, and this shall be limited to a maximum of the invoice value for the repair of the Device.
Westerpark Computers & Telecom must be granted a reasonable period to investigate and, if necessary, rectify the damage incurred. The liability of Westerpark Computers & Telecom shalllapse entirely if, in the meantime, work has been carried out on the Device by a third party.
6.4 Westerpark Computers & Telecom shall never be liable for the loss of data.
6.5 Westerpark Computers & Telecom is not liable for damage to Devices caused by a force majeure situation, including but not limited to burglary, leakage, fire, and flooding.Â
6.6 Westerpark Computers & Telecom shall adequately insure itself and remain insured against the damage referred to in article 6.5. In all cases where Westerpark Computers & Telecom is obliged to pay compensation for damages, this shall be limited to the amount paid out under Westerpark Computers & Telecom's liability insurance in the case in question.
6.7 In the event of a demonstrable total loss of a Device due to an error by Westerpark Computers & Telecom, the actual market value of the Device in question (based on brand, type, and age) shall be used as the starting point for compensation, with an absolute maximum of €400 for Consumers and €250 for Business Customers. In no case shall Westerpark Computers & Telecom be obliged to replace the Device with a new one.
6.8 Westerpark Computers & Telecom is not liable for damage to products and/or Devices caused by laser engraving, laser cutting, or 3D printing. Having products engraved, cut, or 3D printed is entirely at the customer's own risk. The Customer guarantees that the designs, (3D) files, or materials provided by them do not infringe upon the intellectual property rights (such as copyrights or patents) of third parties. The Customer fully indemnifies Westerpark Computers & Telecom against any third-party claims in this regard. Due to the technical characteristics of 3D printing, minor dimensional deviations (tolerances) from the digital design may occur; such deviations shall never entitle the Customer to compensation or termination of the agreement. Â
6.9 Westerpark Computers & Telecom is not responsible for the finish and durability of products. The finish and durability of any product that is laser cut and/or engraved or manufactured using a 3D printer depend on various factors, such as (but not limited to) the material, color, font, layer thickness, print orientation, and design. Laser engraving or cutting causes burn marks on the material. Westerpark Computers & Telecom does its utmost to ensure a neat finish. All products are thoroughly cleaned after production; however, it cannot be guaranteed that all marks will be removed. This depends on the type of material and the chosen color. In addition, the durability of products depends primarily on the font, design, and material. For instance, a cut-out text/design with an elegant font and/or thin edges is more fragile than a thicker font. The Customer acknowledges that due to the layer-by-layer construction, 3D-printed products may contain visible print lines and may be mechanically weaker than industrial plastic. In principle, 3D-printed objects are not suitable for load-bearing, safety-critical, or medical applications, unless expressly agreed otherwise in writing. Westerpark Computers & Telecom will always inform the Customer in advance about the potential risks of the material/color/font, etc., chosen by the customer. If the Customer nevertheless wishes to proceed with his/her order, this shall be entirely at the Customer's own risk.
Article 7: Visual Material and Promotion (Social Media & Website)
7.1 Westerpark Computers & Telecom (including Laserlab Amsterdam) is entitled to take photos and video recordings of the products manufactured, processed, cut, or engraved by it. This applies both to products supplied entirely by Westerpark Computers & Telecom itself and to products provided by the Customer to be processed.
7.2 Westerpark Computers & Telecom has the right to use this visual material for promotional purposes, including but not limited to placement on its websites, webshops, portfolio, and social media channels (such as Instagram, Facebook, TikTok, etc.).
7.3 If the product to be photographed or filmed contains identifiable personal data (such as a full name, date of birth, or a portrait photo of a natural person) and the Customer is a Consumer, Westerpark Computers & Telecom will request prior consent (orally or in writing) before publishing the visual material, in accordance with applicable privacy legislation (GDPR).
7.4 If the Customer is a Business Customer, they automatically consent to the publication of the visual material (including any company names or logos) for promotional purposes by entering into the agreement, unless the Business Customer has explicitly indicated objection to this in writing prior to production.
7.5 The Customer can never derive any right to (financial) compensation or intellectual property from the use of the visual material by Westerpark Computers & Telecom.
